Mayra Bryce, our Partner and Dispute Resolution Specialist, was a speaker at the panel “Investor State-Mining Arbitral Disputes and Critical Minerals – The Emerging Lex Mineralia in the Era of Energy Transition.” This panel explored recent investor-state arbitration decisions in the mining sector, highlighting how they established transnational precedents through the interaction between national and international law. It examined how these decisions allowed for the evaluation of the degree of nationalism regarding resources, the effectiveness of arbitral solutions in the development of critical minerals, and the potential emergence of a lex mineralia in the context of the energy transition.
This panel took place on April 3 at 11:45 a.m. at the JW Marriott Lima and was part of the international event Special Institute on International Mining and Energy Law, Development, and Investment – Lima, Peru 2025, organized by The Foundation for Natural Resources and Energy Law (FNREL).
